Terms of Service

1. Agreement

These Terms govern your use of Lumba (the mobile app, this web app, and related services, together the “Service”). By creating an account or using the Service you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.

2. Eligibility

You must be at least 18 years old to use Lumba. You must provide accurate information at sign-up, keep your credentials secure, and use one account per person. Accounts of users found to be under 18 will be deleted.

3. What Lumba is (and is not)

Lumba is a platform: it helps players discover pickup volleyball games, clubs, teams, leagues, and tournaments, and helps organizers manage them. Lumba does not organize, host, supervise, or control the physical games themselves. Games are created and run by independent users (“organizers”). We do not employ organizers, own venues, or officiate matches.

4. Assumption of risk (please read carefully)

Volleyball is a physical sport. You participate in any game, practice, or event discovered through Lumba voluntarily and at your own risk. To the maximum extent permitted by Philippine law, you accept full responsibility for any injury, loss, or damage arising from your participation, and you agree that Lumba and its operator are not liable for the acts or omissions of organizers, players, venues, or other third parties. Assess your own fitness, the venue, and the conditions before playing.

5. Fees and payments

• Lumba is free to play. Browsing, joining, and hosting games costs nothing.
• Court or session fees shown on a game are set and collected by the organizer (e.g. via GCash at the venue). They are informational on Lumba. We do not process, hold, or refund these payments. Disputes about fees are between you and the organizer.
• The mobile app offers one optional purchase, Remove Ads, a one-time payment processed by Apple or Google under their store terms. Refunds follow Apple/ Google policy.

6. Community conduct

You agree not to:

• harass, threaten, or discriminate against other users, or post content that is unlawful, hateful, or sexually explicit;
• no-show repeatedly, misrepresent your skill tier, or manipulate ratings, reliability scores, or verification;
• impersonate others, use another person’s photo for verification, or create fake accounts or games;
• spam, scam, solicit off-platform payments deceptively, or scrape or misuse other users’ personal data;
• interfere with the Service (probing, reverse engineering, automated abuse, circumventing limits or blocks).

Our community guidelines (shown in-app) form part of these Terms. We may remove content, suspend, or permanently ban accounts that violate them, with or without notice, at our reasonable discretion. Reliability scores, strikes for late cancellations, and reporting/blocking tools exist to keep games trustworthy; using them in bad faith is itself a violation.

7. Your content

You keep ownership of the content you post (profile, game listings, messages, club/team/league pages, photos). You grant Lumba a non-exclusive, royalty-free, worldwide license to host, display, and distribute that content solely to operate and promote the Service (e.g. showing your game on the public discover page). You are responsible for having the rights to what you post. We may remove content that violates these Terms or the law.

8. Organizers, clubs, leagues, tournaments

If you create games, clubs, teams, leagues, or tournaments, you are responsible for what you run: accurate listings, lawful conduct at the venue, honoring the fees you advertise, and complying with venue rules and local regulations. Verified badges and organizer status are trust signals, not endorsements. We may revoke them at any time.

9. Voice rooms: code of conduct

Voice rooms are live, adults-only (18+) group audio. They are transmitted in real time and are not recorded by us. Everything in Section 6 applies; the rules below are the specific code of conduct for voice rooms and room chat. By joining, you agree to them.

In a voice room, do not:

• harass, threaten, bully, or stalk anyone, or engage in gender-based harassment (catcalling, sexist or homophobic slurs, unwanted sexual remarks), which is prohibited by the Safe Spaces Act (RA 11313);
• use hate speech or discriminate based on sex, gender, sexual orientation, religion, ethnicity, or disability;
• share sexual or sexually explicit content, or make sexual advances toward anyone;
• endanger or exploit a minor in any way, or attempt to contact a minor for that purpose (RA 7610). Lumba is 18+; if you believe a minor is present, report it immediately;
• secretly record other participants. We don’t record rooms, and recording a private conversation without the consent of all parties can violate the Anti-Wiretapping Act (RA 4200);
• impersonate others, spam, solicit off-platform payments deceptively, or share another person’s private information (doxxing).

Keeping rooms safe. You can mute yourself any time, block a user (a blocked user can never share a room with you), and report anyone for the reasons above. Room hosts can mute or remove participants. If several people report the same user in a short window, that user is automatically muted pending review. Reports go to a moderation queue reviewed by our team; violations may lead to removal from a room, loss of voice access, suspension, or a permanent ban. Direct messages auto-delete after 24 hours.

10. Termination

You may delete your account at any time (deletion is immediate and irreversible; see the Privacy Policy). We may suspend or terminate accounts that violate these Terms, create risk for other users, or where the law requires. Sections 4, 7, 11, and 12 survive termination.

11. Disclaimers and liability

The Service is provided “as is” without warranties of any kind, express or implied, including fitness for a particular purpose, availability, or accuracy of user-generated listings. To the maximum extent permitted by Philippine law, the total liability of Lumba and its operator for any claim arising out of the Service is limited to the amount you paid us in the 12 months before the claim (which, for free users, is zero). Nothing in these Terms excludes liability that cannot be excluded under Philippine law.

12. Governing law and disputes

These Terms are governed by the laws of the Republic of the Philippines. Disputes shall be brought before the competent courts of the Philippines. Please contact us first. Most issues can be resolved directly.

13. Changes

We may update these Terms as the Service evolves. For material changes we will update the date above and show an in-app notice; continued use after the effective date constitutes acceptance.
